Ombud Raises Red Flag Over Claims on Unroadworthy Vehicles

The National Financial Ombud Scheme (NFO) has recently reminded motorists that keeping your vehicle in a safe and legal condition is both a legal requirement and a contractual obligation under your insurance policy.

In a recent article by Moonstone, the Ombud highlighted that:

  • Tyres and brakes are the most common reasons for claims being rejected.
  • Insurers may rely on expert evidence to prove a lack of roadworthiness.
  • A rejection of claim may only be valid if the vehicle’s condition was material to the cause of the loss.

Two case studies illustrate this:

  • A claim was rejected where aquaplaning caused by an unroadworthy tyre led to an accident.
  • A claim was upheld where worn brakes were not proven to have caused the incident.
